Welcome to Momentum Bot (“Momentum”, “we”, “us”, “our”). By adding Momentum to your Discord server, using our website at momentumbot.gg, or interacting with our services (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Who Can Use the Service

You must be at least 13 years old (or the minimum age required to use Discord in your country, whichever is higher) to use Momentum. By using the Service you represent that you meet this requirement and that you have the legal authority to bind any Discord server you add Momentum to.

Server owners and administrators who add Momentum are responsible for how the bot is configured within their community and for ensuring members are informed of its use.

2. The Service

Momentum is a Discord moderation bot that helps server administrators detect and manage spam, scams, toxicity, and repeat offenders. Features include:

• Automated moderation actions (timeout, kick, ban) based on configurable rules
• Cross-server threat intelligence on known bad actors
• Case files and audit trails for moderation incidents
• Anti-swear filtering and auto-lift of expired actions
• Premium tiers with higher limits and additional protections

We may change, suspend, or discontinue any feature at any time without notice. We do not guarantee the Service will be uninterrupted, error-free, or that moderation actions will always be accurate.

3. Your Responsibilities

You agree not to:

• Use Momentum to harass, defame, or unlawfully target any person or group
• Attempt to reverse-engineer, decompile, or extract data from the Service
• Abuse, overload, or attempt to disrupt the bot’s infrastructure
• Resell, sublicense, or commercially redistribute access to Momentum without written permission
• Use the Service in any way that violates Discord’s Terms of Service or Community Guidelines
• Process sensitive personal data (health, biometric, racial/ethnic origin, political opinions, religious beliefs, etc.) through Momentum

You are solely responsible for the configuration of Momentum in your server and for any consequences of moderation actions taken by the bot.

4. Premium Subscriptions

Momentum offers paid Premium tiers. By subscribing you agree to the following:

• Billing. Payments are processed by Stripe. We do not store your full card number. Billing is recurring on a monthly cycle until cancelled.
• Pricing. Prices are listed on the pricing section of our website and may change with reasonable notice. Existing subscriptions remain at the current rate until renewal.
• Refunds. Refunds are handled on a case-by-case basis at our discretion. Contact legal@momentumbot.gg within 14 days of a charge to request a review.
• Cancellation. You can cancel at any time via the /premium manage command in Discord or through the Stripe customer portal. Cancellation stops future renewals but does not refund the current period.
• Tier Limits. Premium Plus tiers have member-count thresholds. If your server grows beyond your tier’s limit, you must upgrade or some features may be paused.

5. Acceptable Use of Moderation Data

Momentum generates case files, audit logs, and threat-intel records. Server administrators may access and export data related to their own server. You agree:

• Not to use exported data to doxx, threaten, or harass individuals
• Not to share private case files publicly without redacting identifying information
• That threat-intel contributions (e.g. flagging a known scammer) are submitted in good faith

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that:

• Moderation actions will be accurate, fair, or free from false positives
• The bot will be available at all times
• Your data will never be lost or corrupted

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) Momentum.

7. Limitation of Liability

To the extent permitted by law, our total aggregate liability for any claim arising out of these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $50, whichever is greater.

Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. gross negligence or willful misconduct in jurisdictions where such limits are void).

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of Momentum, your violation of these Terms, or your violation of any third-party rights or applicable law.

9. Termination

You can stop using Momentum at any time by removing the bot from your server. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if we discontinue the Service. Sections on Disclaimers, Limitation of Liability, Indemnification, and General survive termination.

10. Intellectual Property

Momentum, its name, logo, source code (where not open-licensed), and documentation are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. Open-source components remain under their respective licenses.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via our support Discord or by email if we have your address. Continued use after changes take effect constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law principles. Any dispute will first be attempted through good-faith negotiation. If unresolved within 30 days, disputes will be resolved in the courts of Denmark, unless you are a consumer entitled to bring a claim in your local jurisdiction under mandatory consumer-protection law.

EU consumers retain any mandatory rights under Directive (EU) 2011/83 on consumer rights and applicable national consumer-protection law.

13. General

• If any part of these Terms is found unenforceable, the rest remains in effect.
• You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset sale.
• No waiver by us of any breach is a waiver of any future breach.
• These Terms constitute the entire agreement between you and us regarding Momentum.
